Legal opinion: Ammunition limits for firearm owners who hold both a Section 13 licence for self-defence and a Section 16 licence for dedicated sport shooting

At the centre of the issue is the interpretation of Section 90 of the FCA, which limits ammunition possession to 200 rounds per firearm, but provides an exemption for individuals who are dedicated hunters or sports persons. The key legal question is whether this exemption applies to the individual as a whole, or only to firearms licensed under Section 16.

Why statements given too early can complicate a self-defence case

Self-defence cases are assessed against strict legal criteria. The immediacy of the threat, the proportionality of the response, and the absence of alternatives all play a role.

A statement given too quickly may unintentionally weaken how those elements are understood. Phrasing, assumptions, or attempts to justify actions in the moment can introduce ambiguity.

Man found not-guilty after shooting and killing three hijackers

Firearms Guardian shares this remarkable story as a stark reminder of the dangers faced by South African motorists and to emphasise the critical importance of proper firearm training.

Incident Overview: Hijacking Attempt in Fordsburg, Johannesburg

A man from Fordsburg, Johannesburg, was charged with three counts of murder after he shot and killed three hijackers during an attempted carjacking. The incident occurred while he was driving with his cousin to purchase hunting equipment.

According to court testimony at the South Gauteng High Court, the accused was picked up by his cousin and was on the way to a firearm dealer when their vehicle was suddenly blocked by a Volkswagen Golf, which screeched to a halt in front of their car. The accused sensed an imminent hijacking attempt.

He described hearing gunshots and seeing a muzzle flash from inside the Golf. As his cousin shouted, “shoot them,” he fired back, exchanging several shots with the hijackers. One of the hijackers exited their vehicle during the shootout. Eventually, the attackers ceased fire.

Court Ruling: Justifiable Self-Defence

The court ruled that the accused’s actions were proportional to the threat faced and that he was justified in defending himself. He was found not guilty and acquitted on all charges.

Expert Legal Opinion by Dr. Llewelyn Curlewis

Dr. Curlewis, a criminal law expert, commented:

“This judgement proves that our courts sometimes do get it right. Unfortunately, the accused and his cousin had to endure the trauma of the legal process despite being victims of a violent crime. This case perfectly illustrates the proper application of self-defence law, where the prosecution could not prove ‘unlawfulness’ beyond reasonable doubt. Kudos to both men for acting decisively and making the world safer.”

Importance of Proper Firearm Training

This case underscores why legally armed citizens must be properly trained. Quick thinking and responsible firearm handling can save lives in critical situations.
