In South Africa, this is not how the judicial system works.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Even when the use of force appears justified, a criminal investigation is mandatory.<\/p>\n\n\n\n<div style=\"height:20px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>The legal reality<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">When a firearm is discharged or used against another person, the state has a duty to investigate. This duty exists regardless of intent.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The investigation seeks to determine:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Whether the threat was real and immediate<\/li>\n\n\n\n<li>Whether the response was proportionate<\/li>\n\n\n\n<li>Whether there were alternatives<\/li>\n\n\n\n<li>Whether the shooter acted lawfully<\/li>\n\n\n\n<li>Whether the defensive act was reasonable<\/li>\n<\/ul>\n\n\n\n<div style=\"height:20px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<p class=\"wp-block-paragraph\">This process protects both the public and the accused.<\/p>\n\n\n\n<div style=\"height:20px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>The role of the police<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The South African Police Service are legally obligated to open a docket following any shooting or fatal injury.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This may include:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Arrest or detention<\/li>\n\n\n\n<li>Firearm seizure<\/li>\n\n\n\n<li>Ballistic testing<\/li>\n\n\n\n<li>Witness statements<\/li>\n\n\n\n<li>Scene reconstruction<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">An investigation does not mean discrimination.
